TERMS AND CONDITIONS OF SALE

1. Validity of terms and conditions of sale

The terms and conditions of sale shall apply to the rights and obligations arising between the customers of smartlifesavers.com online store (hereafter referred to as Customer) and the juridical body behind smartlifesavers.com online store Münt Grupp OÜ (hereafter referred to as Münt Grupp) with the purchase of goods.

In addition to these terms and conditions, the legal relationships arising from the purchase of products from smartlifesavers.com online store shall be regulated by the legislation applicable in the Republic of Estonia.

Münt Grupp shall reserve the right to change the terms and conditions of sale and the prices. These changes will be displayed on smartlifesavers.com web page.

2. Price information

All prices at smartlifesavers.com online store include a value added tax of 20%.
Discount percentages displayed are rounded off to full figures.

3. Placing an order

To order, find the items you wish to order and add them to your shopping cart. You can view the items in your shopping cart by clicking on the cart icon on the top of the web page.

You can change the quantity of items in your shopping cart by writing the desired number in the appropriate field. If you want to delete the item from your cart, click on the cross placed on the same line with the item, after the price.

Before proceeding with your order, please choose the preferred delivery method. The delivery is free in Estonia on all orders exceeding 30 €.

To proceed with your order, please click on “proceed to checkout“. If you are a registered user of smartlifesavers.com online store, proceed to log in to your account. If you are making your first order, please fill in your contact details in the required fields of “new customer“.

To confirm your order, click on “place order“. Next, a pro forma invoice will be generated and you can proceed immediately with a payment using your credit card, a bank link or by making a bank transfer. An order confirmation and a copy of your invoice will be sent to your email address. You can view your orders history and invoices any time you want under „My account“.

Your order will be shipped after the receipt of payment.

4. Entry into force of the contract of sale

The Customer undertakes to pay for the order after clicking „place order“.

The contract of sale shall enter into force after the receipt of the payment made by the Customer on the bank account of Münt Grupp OÜ.

5. Delivery

After the entry into force of the contract of sale (after the receipt of the payment made by the Customer), Münt Grupp will assemble the order and hands it over to the transport service provider for delivery.

Orders placed and paid for on workdays before 12:00 PM will be delivered the next day or according to the delivery time indicated on the product card. Delivery for Estonian islands may take up to 3 days. If the delivery is delayed, the Münt Grupp customer support will arrange  a convenient delivery time with the Customer.

In order to avoid delays in delivery, the order forms have to be filled in carefully and the delivery information submitted should be accurate and valid.

Products damaged (but not its packaging) during transportation shall be replaced to the Customer. Should the replacement be impossible, the Customer shall receive a refund equal to the price of the products.

Münt Grupp shall not be held responsible for a delay in delivery if the goods were handed over to the transport service provider on time, but the delivery was delayed due to circumstances that Münt Grupp  could not foresee or control.

6. Return policy

Items purchased through smartlifesavers.com online store may be returned within 14 days of the date of the receipt. Should the Customer find the purchased item unsuitable, s/he can return it to the online store without indicating the cause for return.

To return purchased items, please contact our Customer Support by dialing (+372) 6 564 130 or file a complaint and send it to info@myntgrupp.ee within 14 days of the date of the receipt of the goods.

According to regulations set by the Estonian Consumer Protection Board (click here), the right of withdrawal does not apply to goods that are not suitable for return for hygiene reasons. The returned goods must be unused and its original package intact and undamaged.

Should it become inevitable that the Customer has to pay the return costs, the online store shall refund the cost of purchased items and return costs no later than within 14 days following the receipt of the request for withdrawal.

The withdrawal period of 14 days shall not apply to the following items:

items produced taking into account the Customer’s specific needs;
items produced custom-made according to conditions set out by the Customer;
items mixed or diluted with some other product or items, so that they can no longer be separated from each other;
items used for business and professional activity purposes;
breakdown or failure resulting from improper use of the appliance (failure to follow instructions for use);
appliance that had been plugged in wrong voltage;
broken items or items with mechanical damage (e.g. after falling);
damage as a result of normal wear and tear or in the event of faults which do not cause the appliance’s depreciation of value nor impair its use;
the appliance has undergone repairs by a technician/repair center not authorized by the manufacturer.
If the Customer does not receive the items he had ordered, or the items delivered do not correspond to the description provided on the web page, or items appear defective, the Customer may, instead of filing a request for withdrawal within 14 days of receipt, use his/her right arising from the law to submit a complaint.

7. The use of the purchased items/goods for business or professional activity purposes (incl. legal persons)

In the event where purchased items have been used for business or professional activity purposes or have been purchased by a legal person, the ordinary complaints procedure shall not apply. In these cases, the period for filing a complaint is usually 6 months or more – depending on the time limits set by the manufacturer. During this period, if the manufacturer’s defect had been detected, the item will be replaced or will undergo a repair.

The items shall not be subject to retun if:

items produced taking into account the Customer’s specific needs;
items are produced custom-made according to conditions set out by the Customer;
items are unsuitable for return due to health protection and hygiene reasons or if their packaging is removed after delivery (cosmetics etc);
items are mixed or diluted with some other product or items, so that they can no longer be separated from each other;
breakdown or failure resulting from improper use of the appliance (failure to follow instructions for use);
appliance was plugged in wrong voltage;
items have mechanical damage or are broken (e.g. after falling);
damage as a result of normal wear and tear or in the event of faults which do not cause the appliance’s depreciation of value nor impair its use;
the appliance has undergone repairs by a technician/repair center not authorized by the manufacturer.

8. Liability

Should Münt Grupp or the Customer breach the present terms and cause damage to the other party, the breaching party shall be liable to the non-breaching party in the events and to the extent provided for in the legislation of the Republic of Estonia.

9. Force majeure

Münt Grupp shall not be held liable for the damage caused or for delivery delays, if the damage or delay is caused due to circumstances Münt Grupp could not foresee or control.

10. Processing of personal data

The information and personal data collected when visiting smartlifesavers.com online store and during the processing of orders shall be treated as confidential and shall not be disclosed to third parties.

Encrypted communication with banks during the payment of goods ensures the security of the Customer’s personal bank details.

The online store only uses the personal data entered by the Customer (including name, phone, number, address, e-mail and bank details) for processing the order and sending goods to the Customer. The online store forwards personal data to the transport service provider in order to deliver goods.

The online store sends newsletters and offers to the Customer’s e-mail address only if the Customer has expressed their wish to receive them by entering their e-mail address on the website and indicating their desire to receive direct mail.

The Customer is able to opt out of offers and newsletters sent to their e-mail address at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.

11. Complaints procedure

Münt Grupp is responsible for the non-compliance of goods sold to the Customer with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the goods to the Customer. Within the first six months of delivery, it is assumed that the defect was present at the time of delivery. It is Münt Grupp responsibility to prove otherwise.

The Customer has the right to turn to the online store within two months of the occurrence of a defect by emailing to info@myntgrupp.ee or dialing (+372) 6 564 130.

The complaint should contain the following information:

Customer’s name and contact details;
Date of presenting a complaint;
Description of the product’s defects;
Complaint being presented to Münt Grupp;
Reference to documents, confirming the fact of the transaction or a warranty, or provide their copies in the attachment.
Münt Grupp will reply to a complaint in writing within 15 days as of the receipt of the complaint from the Customer. If Münt Grupp is unable to provide a response to the Customer’s complaint within 15 days, Münt Grupp will inform the Customer of that in writing, stating the reason for delay and the date by which the response will be provided.

Münt Grupp shall not assume liability for defects that have resulted through the Consumer’s fault, either due to improper storage or non-intended use of products. Defects are product defects, not defects of packaging.

Should the goods appear to be non-compliant to the contract’s terms and conditions, or have defects or malfunctions, the Customer shall have the right to demand the repair or replacement of the goods. If the repair or replacement is impossible, or proves unsuccessful, or causes the Customer unreasonable inconvenience, the Customer shall retain the right to withdraw from the contract and claim the return of money.

If the Customer and Münt Grupp are not able to settle the dispute by agreement, the Customer may contact the Consumer Dispute Committee.

You can review the procedural rules and submit a complaint here. Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the Online Store. Resolution of disputes by the Consumer Dispute Committee is free of charge for the purchaser.
